Hasan Piker reportedly received a U.S. Treasury (OFAC) subpoena over transactions tied to his recent Cuba trip — and a second, criminal track is now in view: 18 U.S.C. § 951, the federal statute for acting as an agent of a foreign government. The question reaches past one streamer: Fox News Digital's Asra Nomani has reported contacts between the Cuban Embassy and a St. Louis–based activist network whose leaders were already prosecuted under that same statute. On May 9, 2026, Cuban diplomat David Ramírez Álvarez addressed activists by video link at Machinists Hall in Wilmington, California, in a session moderated by Mwezi Odom of the African People's Socialist Party — the group behind the "Hands Off Uhuru" campaign for its chairman, Omali Yeshitela. Yeshitela was indicted alongside Russian FSB officers in United States v. Ionov (M.D. Fla.). On September 12, 2024, a Tampa jury acquitted the Uhuru defendants of acting as Russian agents under § 951 and convicted them only of conspiracy; on December 16, 2024, they were sentenced to 36 months' probation and 300 hours of community service — no prison, no fines.
It reads as a free-speech story, and last time the speech defense won — the judge imposed no prison, viewing the conduct as rooted in protected speech. But § 951 turns on acting under a foreign government's direction or control without notifying the Attorney General — not on anyone's opinions. And Cuba isn't only about speech: it's about money — transactions with a sanctioned, military-controlled regime. The open question is whether the speech shield that held for Russia also covers coordination with Havana once that coordination starts to look like dollars moving to an embargoed state. A subpoena is not a charge, and nothing here establishes that any individual broke the law.
